Martindales Limited online payment gateway terms and conditions
Please read these terms carefully before using the online payment gateway. By using the online payment gateway on this website you accept these terms. If you do not accept these terms do not use this gateway.
Definitions and interpretation
The terms used in this agreement have the meanings set out below unless the context requires otherwise:

All payments are subject to the following conditions:
Service provider
Online payments of policy excesses and goods/services can be made by credit or debit card. These payments are not collected by Martindales directly but by the service provider.
Security
The payment process complies with the Payment Card Industry Data Security Standard (PCI DSS) and all payment details which are entered through the online payment gateway are encrypted when you enter them.
Martindales shall not be liable for any failure by you to properly protect data from being seen on your screen by other persons or otherwise obtained by such persons, during the online payment process or in respect of any omission to provide accurate information in the course of the online payment process.
Payment and payment confirmation
When you make an online payment a payment confirmation email will be sent to the e-mail address provided by you. If this is not received within it is your responsibility to check with Martindales and/or your Account provider that the payment has been made.
Unless payment is refused or declined for any reason, your payment will show on your Account by the next working day.
Martindales cannot accept any liability if payment is refused or declined for any reason.
If payment is refused or declined for any reason Martindales is under no obligation to bring this to your attention. It is your responsibility to check with your Account provider that the payment has been made.
Refund policy
Refunds, if applicable, can only be credited back to the Account used for the original transaction and will be made within one day of the transaction being paid.
Payments taken in error by Martindales will be refunded in the same manner and any subsequent bank charges applied by your bank will also be refunded provided documentary evidence of the imposition of those charges is supplied by you.
Data protection
In this clause the term “personal data” is as defined in the Data Protection Act 1998.
Martindales will collect (or may already hold) personal data relating to you, including your Account details, your e-mail address, your name and address and the billing address of your Account (if different) in accordance with Martindales data protection policy.
By agreeing to be bound by these terms and conditions you accept and consent to your personal data, as detailed in clause above, being provided to the service provider for sole purpose of the service provider administering the payment or payments you are making by the online payment gateway.
It is your responsibility to ensure that all personal data provided to or held by Martindales and/or provided to the service provider is clear and accurate. Martindales will not be responsible for any losses suffered by you as a result of inaccurate information being provided to Martindales or the service provider.
Martindales may use the personal information provided to it to contact you to clarify or resolve any issues that arise in connection with any payment or payments made by you.
